1. Introduction
Welcome to GaterZone (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our on-premise Privileged Access Management (PAM) solution, related services, and website. By purchasing, installing, or using our software, you agree to these Terms.
If you do not agree to these Terms, you may not access or use GaterZone.
2. Definitions
“Software” refers to the GaterZone PAM product provided to you under these Terms.
“Customer” refers to any entity that purchases or subscribes to GaterZone.
“User” refers to any individual authorized by the Customer to use the Software.
“License” means the right granted to use the Software under these Terms.
3. Scope of Service
GaterZone provides an on-premise PAM solution. This means:
You are responsible for installing, maintaining, and operating the Software within your environment.
We do not collect or store your user session data, authentication logs, or system access information.
We provide support, updates, and security patches as defined in your licensing agreement.
4. License and Restrictions
4.1. License Grant
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, and revocable license to use GaterZone strictly for internal business purposes.
4.2. License Restrictions
You may not:
Reverse engineer, decompile, or attempt to extract the Software’s source code.
Modify, distribute, or create derivative works based on the Software.
Rent, lease, or resell the Software to third parties.
Use the Software for unlawful or unauthorized purposes.
5. Customer Responsibilities
As GaterZone is an on-premise solution, you agree to:
Ensure proper deployment, security, and maintenance of the Software.
Prevent unauthorized access and misuse of the Software.
Back up your data to prevent loss due to hardware failure or cyber incidents.
6. Support and Updates
We provide technical support based on your purchased service plan.
Updates and security patches will be released periodically and must be applied by the Customer.
Custom modifications to the Software are not covered under standard support agreements.
7. Fees and Payment Terms
Fees for GaterZone licenses and services are specified in your purchase agreement.
Payments are non-refundable unless stated otherwise.
Failure to pay may result in suspension or termination of access to support and updates.
8. Data Privacy and Security
We collect and process only necessary business data (e.g., company details, contact information, and billing details).
We do not access, collect, or store any user session logs, authentication details, or privileged access credentials.
We do not share customer data with third parties, except as required by law.

9. Intellectual Property Rights
GaterZone and all associated trademarks, logos, and copyrights are owned by us.
You may not claim ownership of the Software or any related intellectual property.
If you provide feedback or suggestions, we may use them without any obligation to compensate you.
10. Compliance with Regulations
GaterZone is designed to comply with:
General Data Protection Regulation (GDPR)
Health Insurance Portability and Accountability Act (HIPAA)
National Institute of Standards and Technology (NIST) Guidelines
Other applicable cybersecurity and data protection laws
Customers are responsible for configuring and using the Software in compliance with relevant regulations.
11. Warranties and Disclaimers
We warrant that GaterZone will perform in accordance with its official documentation.
We do not warrant that the Software will be completely free of errors or vulnerabilities.
The Software is provided “as-is” without any warranties, express or implied.
We are not liable for data loss, security breaches, or other damages arising from misconfiguration or misuse.
12. Limitation of Liability
To the maximum extent permitted by law:
Our liability for any damages related to the use of GaterZone shall not exceed the total amount paid by you in the past 12 months.
We are not responsible for indirect, incidental, or consequential damages (e.g., lost profits, data breaches, or reputational harm).
13. Indemnification
You agree to defend, indemnify, and hold harmless GaterZone against any claims, damages, or expenses arising from:
Unauthorized or improper use of the Software.
Violation of these Terms or applicable laws.
Security breaches resulting from misconfiguration or negligence.
14. Termination
We may suspend or terminate your license if:
You violate these Terms.
Payment obligations are not met.
You misuse or attempt to tamper with the Software.
Upon termination, you must immediately cease using the Software and remove all copies from your systems
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Netherlands.
Any disputes arising from these Terms or the use of the Software shall be resolved through the relevant courts in the Netherlands.
We encourage disputes to be resolved through negotiation before pursuing legal action.
16. Amendments to These Terms
We may update these Terms from time to time.
Updates will be communicated via email or posted on our website.
Continued use of GaterZone after an update constitutes acceptance of the new Terms.
